1. About the PATHOS Performance Nutrition App

The PATHOS Performance Nutrition app is a nutrition tracking and coaching platform intended for clients participating in PATHOS Performance Nutrition coaching services.

Access to the app may require an active PATHOS Performance Nutrition personal coaching membership and an account authorized by PATHOS.

The app allows clients to track nutrition, calories, macronutrients, food intake, body weight, progress, and other information relevant to their nutrition and performance goals. It also allows PATHOS coaches to establish nutrition targets, review client progress, and communicate with clients.

PATHOS Performance Nutrition provides nutrition education and coaching services. The app and coaching services are not intended to diagnose, treat, cure, or prevent any disease or medical condition and are not a substitute for care from a physician, registered dietitian, or other qualified healthcare professional.

2. Information We Collect

Depending on how you use the PATHOS app and services, we may collect the following categories of information.

Account and Contact Information

We may collect information necessary to create, maintain, and authenticate your account, including:

• Email address

• Account credentials

• User or account identifiers

• Coaching membership or account status

Nutrition and Food Information

When you use the app to track your nutrition, we may collect information such as:

We or service providers supporting the operation of the app may automatically receive limited technical information necessary to operate, secure, diagnose, and improve the service. This may include information such as:

4. Food Search and Open Food Facts

PATHOS uses data from Open Food Facts, an independent, community-supported food products database, to support certain food search and barcode-scanning functionality.

When a user searches for a food or scans a product barcode, PATHOS may request product and nutrition information from Open Food Facts and display relevant information within the app.

Open Food Facts is a third-party service and is not owned or operated by PATHOS Performance Nutrition.

Food and nutrition information obtained from third-party databases may contain inaccuracies, incomplete information, or information submitted by third parties. Users should verify product labels when precise nutrition information is important.

Open Food Facts data is made available under its applicable open-data licensing terms.

5. Camera and Barcode Scanning

PATHOS may request access to your device's camera when you choose to use the barcode-scanning feature.

Camera access is used to scan food product barcodes so that the app can locate corresponding nutrition information.

PATHOS does not use camera access for advertising or unrelated tracking purposes.

You can manage camera permissions through your device's privacy settings.

6. How We Share Information

PATHOS does not sell or rent your personal information.

Information may be disclosed in limited circumstances, including:

PATHOS Coaches and Authorized Personnel

Information you enter into the app may be accessible to your assigned PATHOS coach or other authorized PATHOS personnel when necessary to provide your coaching services, administer your account, provide support, or maintain the service.

Service Providers

PATHOS may use third-party technology providers to provide services such as hosting, database storage, authentication, application infrastructure, error monitoring, communications, or other functionality necessary to operate the app.

These providers may process information only as necessary to provide services to PATHOS and are expected to protect personal information consistent with applicable contractual and legal requirements.

Third-Party Food Data

Food searches and barcode lookups may interact with third-party food databases, including Open Food Facts, as described in this Privacy Policy.

Legal Requirements

We may disclose information if reasonably necessary to:

• Comply with applicable law, regulation, court order, or legal process

• Respond to lawful requests from governmental authorities

• Protect the rights, safety, or property of PATHOS, our clients, or others

7. Data Retention

When information is no longer reasonably necessary for these purposes, it may be deleted or de-identified, subject to applicable legal, contractual, backup, and record-retention requirements.

8. Account and Data Deletion

Users may request deletion of their PATHOS account and associated personal information.

Where account deletion functionality is available within the PATHOS app, users may submit a deletion request through that feature.

Users may also contact PATHOS Performance Nutrition using the contact information provided at the end of this Privacy Policy to request access to or deletion of their personal information.

Upon receiving a valid deletion request, PATHOS will delete or de-identify applicable personal information within a reasonable period, except for information we are legally permitted or required to retain.

Certain information may remain temporarily in secure backups until those backups are overwritten or deleted according to normal retention procedures.

9. Your Privacy Choices

Depending on your location and applicable law, you may have the right to request:

However, no internet transmission, mobile application, database, or electronic storage system can be guaranteed to be completely secure.

Users are responsible for protecting their account credentials and should not share their password with unauthorized individuals.

11. Children's Privacy

The PATHOS Performance Nutrition app is not intended for use by children without appropriate authorization and supervision.

If PATHOS permits a minor to participate in coaching services, appropriate consent from a parent or legal guardian may be required in accordance with applicable law.

If we become aware that personal information from a child has been collected in a manner inconsistent with applicable legal requirements, we will take appropriate steps to address or delete that information.

12. Third-Party Services

The PATHOS app may rely on or interact with third-party services to provide certain functionality.

Third-party services may operate under their own terms and privacy policies. PATHOS encourages users to review the privacy practices of relevant third-party services where appropriate.

PATHOS requires third-party service providers that process PATHOS user information on our behalf to provide appropriate protections for that information consistent with their role and applicable requirements.

13. No Sale of Personal Information

PATHOS Performance Nutrition does not sell personal information obtained through the PATHOS app.

PATHOS does not sell users' nutrition logs, body weight information, coaching information, or private coach-client communications to advertisers or data brokers.

14. Changes to This Privacy Policy

We may update this Privacy Policy periodically to reflect changes to the PATHOS app, our services, legal requirements, or our privacy practices.

When material changes are made, we may update the Effective Date above and provide additional notice when appropriate.

Continued use of the PATHOS app following an updated Privacy Policy will be subject to the updated policy to the extent permitted by applicable law.
